O R D E R

The petitioner, who was arrested and remanded to judicial custody on 29.04.2024 for the alleged offence under Sections 120(b), 147, 148, 450, 302 r/w 149 of IPC in Cr.No.521 of 2017 on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner has earlier arrested and released on bail. During PRC stage, the petitioner was absconded. Hence, non bailable warrant was issued on 02.03.2020 and the same was executed on 29.04.2024 and hence prays to grant bail. 3.The learned counsel appearing for the petitioner submitted that the petitioner was earlier arrested and released on bail. He was regularly appeared before the trial Court. Since Covid-19 Pandemic, the petitioner was not aware about the hearing dates, he was not able to appear before the concerned trial Court and hence non bailable warrant was issued on 02.03.2020 and he was remanded to judicial custody on 29.04.2024. Now, the petitioner being in judicial custody for more than one year and nine months. Hence, he prayed for grant of bail to the petitioner. 2/5

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner is having bad antecedents of 13 previous cases and he has absconded for nearly four years. During Covid-19 Pandemic, Non Bailable Warrant was issued and even after resumption of regular work by the Court, the petitioner was not appeared before the Court and absconded for a longer period. Hence, he opposed for grant of bail to the petitioner.

5. Heard both sides and perused the materials available on record.

Considering the fact that the petitioner was absconded for more than four years and the petitioner is having 13 previous cases, though it is stated that the petitioner is in custody for more than one year and nine months, the report received from the concerned trial Court reveals that there are many accused involved in this case and they have not properly appeared before the trial Court and delayed the trial process. Moreover, the charges have yet to be framed and posted the matter on 12.03.2026 for framing of charges. Hence, at this stage, if the petitioner is granted bail, he will tamper the trial process, I am not inclined to grant bail to the petitioner. 3/5
