Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner apprehends arrest by the respondent police for the offences punishable under Section 7(3) of Lotteries Regulation Act, 1998 in Crime No.85 of 2022, is before this Court seeking anticipatory bail.

On perusal of the First Information Report indicates that based on the secret information, the respondent police has raided the place near Panner Tea Stall, Kuppagounder Street, Dharmapuri, and seized lottery ticket, which is prohibited in the State of Tamil Nadu. From the persons, who were arrayed as A1 and A2, a sum of Rs.15,100/- was also seized. From the confession statement of those accused, the present petitioner has been arrayed as A4. Since the information revealed by the co-accused in their confession statement indicates that the present petitioner is the brain behind the illicit circulation of the lottery tickets in and around Dharmapuri area. https://hcservices.ecourts.gov.in/hcservices/

The learned counsel appearing for the petitioner states that no incriminating materials found against the petitioner and he has been wrongly arrayed as an accused based on the confession statement of the coaccused.

Whether the petitioner is innocent or not has to be determined only during the course of trial. Since the petitioner is absconding and seeks anticipatory bail, there is strong incriminating material found against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
