ORDER

This petition has been filed to modify the conditional order passed by the learned District and Sessions Judge, Mayiladuthurai, Mayiladuthurai District in Crl.M.P.No.2166 of 2023 dated 05.12.2023 as regular sureties instead of clause (c) and (d).

2. Heard the learned counsel on either side and perused the materials placed on record.

3. The case of the prosecution is that while releasing the petitioner's vehicle bearing Registration No.TN 23 AR 7614, Ashok Leyland Tipper Lorry, the District and Sessions Judge, Mayiladuthurai, Mayiladuthurai District in Crl.M.P.No.2166 of 2023 dated 05.12.2023 imposed conditions that the petitioner shall deposit a sum of Rs.1 Lakh as fixed deposit in the name of the petitioner in any nationalized bank and to submit the fixed deposit receipt. It was further directed that the petitioner shall execute a bond for a sum of Rs.10 Lakhs. However, the petitioner is unable to comply with the said conditions. Hence, the petitioner seeks modification of the above said conditions.

4. Considering the facts and circumstances of the case, this Court is not inclined to modify the conditions imposed in Crl.M.P.No.2166 of 2023 dated 05.12.2023 by the District and Sessions Judge, Mayiladuthurai,
