C.V.KARTHIKEYAN, J.

A1 has filed Crl.O.P.No.3558 of 2024 and A2 has filed Crl.O.P.No.3581 of 2024 both seeking bail in Crime No.67 of 2024 registered by the respondent Police for the offences under Sections 3(2)(a), 4(1), 4(2)(c) of Immoral Traffic (Prevention) Act, 1959 and Section 370 of IPC. They were remanded to judicial custody on 26.01.2024. A3 and A4 have filed Crl.O.P.No.2593 of 2024 seeking anticipatory bail in Crime No.67 of 2024 registered by the respondent Police for the offences under Sections 3(2)(a), 4(1), 4(2)(c) of Immoral Traffic (Prevention) Act, 1959 and Section 370 of IPC. 2.The case of the prosecution is that when the respondent Police intercepted a Maruthi Suzuki Ertiga car bearing Registration No.TN 50 BW 6031, they found one victim girl along with A1 and A2 in the car. Various other materials were also seized. It was later found that the victim girl had been restrained by A1 and A2 for the purpose of trafficking. A3 and A4 have secured the victim girl and handed her over to A1 and A2. 1/4

3.The learned counsel for A1 and A2 pointed out the number of days of incarceration and stated that they have suffered incarceration for more than 30 days.

4.The learned counsel for A3 and A4 stated that there is no material against them.

5.A counter affidavit had been filed wherein it has been stated that the statement of victim had been recorded. It it is also seen that further investigation will have to be done particularly with respect to the possibility of other girls having been kidnapped earlier for the purpose of prostitution. 6.The entire network will have to be now determined by the respondent.

7.It is also seen that A3 has one previous case under Immoral Traffic (Prevention) Act which is pending trial and another previous case under Immoral Traffic (Prevention) Act.

8.Taking that factor into consideration and also of the fact that the victim girl was secured from A1 and A2 in the same car, I am not inclined to grant either bail or anticipatory bail to the petitioners. 2/4

9.Hence, all these Criminal Original Petitions are dismissed. 04.03.2024 vkr 3/4
