O R D E R

The petitioner, who apprehends arrest by the respondent police for the alleged offences punishable under Sections 123 BNS, Section 6(b), 24(1) of Cigarette and other Tobacco Products Act, 2003 in Crime No.393 of 2025 registered on the file of the respondent police, seeks anticipatory bail. 1/4

2. The case of the prosecution is that the petitioner joined hands with other accused was found in possession of 390 kgs of banned tobacco products. Hence, a case has been registered against the petitioner.

3. Earlier, this Court had dismissed the bail application on two occasions on the ground that the quantity involved in this case is 390 kgs and that the petitioner is one of the main accused.

4. This is a successive bail application. Though the petitioner has sought bail on the ground that the co-accused has been granted bail. Hence, he prays to grant anticipatory bail to the petitioner.

5. This Court, on perusal of the anticipatory bail order granted to the co-accused, finds that the quantity involved in the case of the co-accused was only 10 kgs of banned tobacco products and that the petitioner has suppressed the said fact while relying on the anticipatory bail granted to the co-accused.

6. Since there is no change in circumstances to revisit the earlier order passed by this Court, this Court is not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, this Criminal Original Petition is dismissed. 18.02.2026 drl 2/4
