ORDER

This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 29.12.2025, seeking bail in Crime No.354 of 2025 registered for the offence under Sections 275 and 123 of BNS,

R/w 24(1) of Cigarettee and Other Tobacco Product Act.

2. The allegation against the petitioner is that the petitioner joined hands with other accused was found in illegal possession of 375 kgs of banned tobacco products. Hence, the complaint has been registered and the petitioner was arrested and is in judicial custody since 29.12.2025.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. He further submits that he is in judicial custody since 29.12.2025 and ready to abide by any conditions that may be imposed by this Court and ready to cooperate with the investigation. Hence, the learned counsel prays to grant bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent Police reiterated the prosecution case and, upon instructions submitted that the total quantity of contraband involved in this case is 375 kgs and that the petitioner is having two previous cases. He further submitted that the investigation in this case is still pending. Hence, he opposed to grant bail to the petitioner.

5. I have heard the submissions made by the learned counsel on either side and also perused the materials available on record.

6. Considering the facts and circumstances of the case, and also taking

note of the submission made by the learned Government Advocate (Crl.Side); nature of allegation; investigation is still progressing; period of incarceration and also the fact that the petitioner is involved in two previous cases, this Court is not inclined to grant bail to the petitioner.
