ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the alleged offence under Sections 457 and 380 of I.P.C and altered to Sections 342, 452 and 395 r/w 397 of IPC in crime No. 437 of 2021 on the file of respondent police, seeks anticipatory bail.
2. Totally there are ten accused in this case and the petitioner herein is A5. It is alleged that the petitioner had broken the door of TASMAC shop and stolen the Brandi bottles and CCTV Camera. Hence, the respondent police registered the case against the petitioner.
3. The learned counsel for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner.
4. The learned Additional public prosecutor would submit that the petitioner is a habitual offender and there are three previous cases pending against the petitioner. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/
5. Considering the fact that the petitioner is a habitual offender and there are three previous case pending against him, this Court is not inclined to grant anticipatory bail to the petitioner.
