ORDER

The petitioner, who apprehends arrest for the alleged offence under Sections 126(2), 296(b) 352,353(2) and 351(3) of BNS in Crime No.22 of 20265 on the file of the respondent police seeks anticipatory bail. 1/4

2. The case of the prosecution is that the petitioners have posted derogatory messages and images in the social media about the legislative member of the Neyveli Assembly, and when the same was questioned by the defacto complainant, the petitioners threatened him with dire consequences. It is reported that due to the act of the petitioner the reputation of the political party is greatly affected. Hence, the case.

The learned counsel appearing for the petitioners submitted that the petitioner has not posted any derogatory messages and he has only uploaded some information regarding the political party which does not affect the reputation of any individual. However, the petitioner is ready to co-operate with the investigation and abide by any other stringent conditions that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioners.

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and also produced the photographs uploaded by the petitioners and it reveals that the petitioners has made derogatory remarks about the legislative member of the Neyveli District .Hence, he opposed to grant anticipatory bail to the petitioner. 2/4

5. Heard both sides and perused the materials available on record.

Considering the submissions made by both sides; even though it is stated that posting of images is only to express their opinion regarding the political activities, it cannot exceed beyond a certain limit and in this case the petitioners have created a great unrest by posting derogatory messages about the siting member of legislative assembly and also contains life threatening messages to him. Some posts are also breaches the privacy of the political personalities which cannot be permissible. Hence, this Court is not not inclined to grant anticipatory bail to the petitioner.
