ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 02.12.2016 for the offences punishable under Sections 341, 294(b), 427, 336, 506(ii), 392 and 397 of IPC in Crime No.1037 of 2016, on the file of the respondent police, seeks bail.

Heard both sides. Documents perused.

Though the learned counsel for the petitioner would contend that the petitioner is in judicial custody for the past 5 years and investigation in this case has been completed and he would not deny the fact that the petitioner is having five previous cases that too, all the cases are registered in respect of the property offences. https://hcservices.ecourts.gov.in/hcservices/

Therefore, if this type of petitioner is released on bail, there may be a chance for tampering the witness and hampering the investigation. Hence, this Criminal Original Petition is dismissed. However, considering the fact that the petitioner is in judicial custody for the past 5 years, it would appropriate to direct the Presiding Officer of the Court to dispose of the trial, within a specific period. Accordingly, the learned Principal Subordinate Judge, Thiruvannamalai, is directed to dispose of the case in S.C.No.160 of 2021, within a period of three months from the date of receipt of a copy of this order and further directed to send a compliance report, without fail.
