2. The delay is 1917 days, which is huge, for which, though reasons have been adused in paragraphs 3 to 5 of the affidavit filed in support of this petition, since a huge delay has occurred, if the delay is condoned, that certainly would prejudice the interest of the respondents and moreover, the present petitioner was the worker, against whom, Disciplinary Proceedings were initiated and ultimately, he was dismissed from service. Though, the petitioner succeeded before the Labour Court, that was reversed by the Writ Court through the order impugned. Therefore, his fate of whether he is entitled to get reinstatement, as directed by the Labour Court through the award which was set aside by the Writ Court through the order impugned, or not could be gone into on merits in the main writ appeal and hence, that chance cannot be thwarted by dismissing the present petition for condoning the delay in representing.
3. In that view of the matter, on payment of costs of Rs.10,000/- (Rupees Ten Thousand Only) to the respondents within a period of four weeks from the date of receipt of a copy of this order, the delay of 1917 days in representing the appeal is condoned. Accordingly, the petition stands ordered on the aforesaid condition.
