This petition is filed to condone the delay of 59 days in filing the above Criminal Appeal.

2. Heard the learned counsel for the petitioner and the learned Public Prosecutor (Pondicherry) for respondents 1 and 2.

Though the notice has been served on the 3rd respondent, there is no representation on behalf of him.

3. Having regard to the submissions made by the learned counsel on both sides and on being satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, the delay of 59 days in filing the Criminal Appeal is condoned and the petition is ordered.
