C.M.P.No.3719 of 2022 in C.M.P.No.14142 of 2106 in S.A.Sr.No.57594 of 2016 P.T.ASHA, J., This application is filed to condone the delay of 1431 days in filing the restoration petition to restore C.M.P.No.14142 of 2016, which was dismissed for non-compliance of the order dated 22.02.2018.

2. Heard the learned counsel for the petitioner / appellant.

3. Notice has been served on the respondents 2 and 3 on 06.04.2022. However, they have not entered appearance. Notice, which was served on the first respondent, has been refused. Therefore, the service is deemed to be completed on the first respondent.

4. The reasons given in the affidavit for condoning the delay clearly points a finger at the counsel. Therefore, the delay is condoned on payment of costs of Rs.2,500/- (Rupees two thousand and five hundred only) by the learned counsel for the petitioner/appellant to the credit of Advocates Clerks Association, on or before 27.07.2022, failing which this order would automatically stands cancelled, without any further reference to this Court. The amount shall be paid by the learned counsel for the petitioner/appellant and not by the party.

4. Post the matter on 28.07.2022 "for reporting compliance".
