PRAYER Writ Petition filed under Article 226 of the Constitution of India, praying to issue Writ of Mandamus, Directing the respondents herein to immediately determine and pay the petitioner due compensation including solatium, interest, penal interest and all other additions attached to it payable under Right to Fair Compensation and Transparency in Land Acquisition and Rehabilitation and Resettlement Act 2013 for site and building in the entire 24.50 Sq.Meters (12 Sq.Meters + 12.5 Sq.Meters) of the petitioner's lands in S.No.433/3A1B, Maduravoyal Village, Thiruvallur District acquired by the respondents for the purpose of expansion of Maduravoyal-Valasaravakkam Road and do the needful at the earliest.

ORDER

This writ petition has been filed to direct the respondents to consider the petitioner's representation dated 18.03.2019 and Legal Notice dated 22.07.2019.

The learned counsel for the petitioner would submit that in this case, the petitioner has given a representation dated 18.03.2019 and a legal notice dated 22.07.2019 to to immediately determine and pay the petitioner due compensation including solatium, interest, penal interest and all other additions

attached to it payable under Right to Fair Compensation and Transparency in Land Acquisition and Rehabilitation and Resettlement Act 2013 for site and building in the entire 24.50 Sq.Meters (12 Sq.Meters + 12.5 Sq.Meters) of the petitioner's lands. However, the said representation was not at all considered by the respondent till date. Hence, this petition.

3. In reply, the learned Special Government Pleader appearing for the respondent would submit that the petitioner's representation dated 18.03.2019 and legal notice dated 22.07.2019 will be disposed of by the respondent within a period of 6 weeks.

4. Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondent and also perused the entire materials available on record.

5. In view of the above, without expressing any opinion on the merits of the matter, this Court directs the respondents to consider the petitioner's representation dated 18.03.2019 and a legal notice dated 22.07.2019 and after affording an opportunity of personal hearing to the petitioner, dispose of the same, on merits and in accordance with law, within a period of 6 weeks from the date of receipt of a copy of this order.
