Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondent to consider the representation of the petitioner dated 13.11.2019 in so far as his name is concerned and consequently direct the respondent University to consider the internal marks obtained by the petitioner in the re - conducted internal examinations along with the external marks scored by him in the external
examinations held during September 2020, and to declare his results within a reasonable time.
For Petitioner : Mr.Prakash Adiapadam For R1 : Mrs.A.V.Bharathi Standing Counsel For R2 : Mr.V.Vasanthakumar Additional Government Pleader (P) O RDER This Writ Petition has been filed for direction directing the respondent to consider the representation of the petitioner dated 13.11.2019 seeking consideration of internal marks obtained by the petitioner in the re - conducted internal examinations along with the external marks scored by him in the external examinations held during September 2020.
2. Heard the learned counsel on either side and perused the materials available on record.
3. The petitioner had joined in the Master of Law (LLM) in the second respondent College which is affiliated to the first respondent University in the month of May 2017 and it is a two years course. As per the regulations, the petitioner ought to have completed the PG degree, within a period of four years from the date of his joining viz., his course will end in the academic session 2020-2021. He had appeared for the first semester held during the month of
December, 2017. But he did not appear for internal examinations for two papers viz., (i) Law and Social Transformation in India and (ii) Indian Constitutional Law: New Challenges. He had appeared for written examination and secured an average of 37 marks out of 75 marks. The petitioner failed to apply for internal examination for the next academic year 2018. He did not secure the required marks to clear the above said two subjects. Once again, the petitioner appeared for the above said two papers and secured 41 and 39 marks respectively. Though the petitioner had appeared for the written examination, he should have approached the concerned College authorities to appear for internal assessment of these two papers in the month of May 2018 itself. But the petitioner submitted a representation to re-conduct the examination for him. However, the petitioner failed to apply for re-conducting of internal examination on time to the college authorities.
4. That apart, the petitioner also failed to give his application for the internal assessment of II semester. The petitioner had joined in the Post Graduate degree LLM course in the year 2017 and as such, he is governed by the Pondicherry University Regulations 2010-2011. Now the petitioner sought for the relief as per the regulations of 2020-2021 which is not applicable to the
petitioner. When the petitioner was absent in the internal assessment for two papers viz., (i) Law and Social Transformation in India and (ii) Indian Constitutional Law: New Challenges, he appeared only for written examinations. As per clause (C) of the Regulations 2010-2011, the passing minimum for each theory paper shall be 50 out of 100 marks, out of 75 marks for external examination and the candidate has to secure a minimum of 35 marks and there is no minimum for internal 25 marks.
5. Therefore, the representation submitted by the petitioner cannot be considered. However, the petitioner is at liberty to approach the second respondent for re-conducting his internal examination for the two papers viz., (i) Law and Social Transformation in India and (ii) Indian Constitutional Law: New Challenges.
6. With the above directions, this writ petition stands disposed of. Consequently, connected Miscellaneous petition is closed. No costs. 24.09.2025 (2/2) Internet: Yes Index : Yes/No Speaking/Non Speaking order mn
