CORAM:

THE HON'BLE MR.JUSTICE T.RAJA W.P.No.1082 of 2017 Alex & Alekzander Paulraj @ J.Antoney Alexander Pushparaj, S/o. John Joseph .. Petitioner Vs.

.. Respondents Prayer: Writ petition filed under Article 226 of the Constitution of India praying to issue a writ of Mandamus directing the second respondent to consider and pass order on the petitioner's representation dated 07.11.2016 in respect of the action to be taken against Mr.A.Bose, President of Burma India Home Construction Co-operative Society, Perambur High Road, Chennai-600 011, the third respondent herein for the irregularity committed by him in the society and conducted full fledged enquiry and take appropriate action.

For Petitioner : No appearance For Respondents : Mr.B.Vivekavanan for R1 & R3 Mr.V.Selvaraj, Additional Govt. Pleader for R2

O R D E R

No one represented for the case of the petitioner although Mr.V.Selvaraj, learned Additional Government Pleader for second respondent and Mr.B.Vivekavanan, learned counsel for first respondent, are present. 2.Learned counsel for the first respondent (Housing Board) would submit that the petitioner is not having any relief against the Housing Board and wrongly, the Housing Board has been impleaded which has caused prejudice to the first respondent. Therefore, the writ petition is liable to be dismissed on the ground of misjoinder of party. 3.Learned Additional Government Pleader appearing for the second respondent would also submit that the writ petition is liable to be dismissed for the reason that the prayer has already been answered by looking into the complaint of the petitioner and the report has already been forwarded to the Deputy Registrar (Housing)/second respondent herein.

4.Therefore, I find no merit in this writ petition. Accordingly the writ petition fails and the same is dismissed. No costs. 12.01.2017 Index : Yes/No kal To 1.The Tamil Nadu Housing Board, Rep. by its Chairman and Managing Director, Anna Salai, Nandanam, Chennai-600 035.
