ORDER
This writ petition has been filed to prohibit the third respondent or his subordinates from proceeding with the enquiry dated 05.01.2026 in the application filed by the fifth respondent, seeking for issuance of patta in her name for the property morefully described in the prayer to this writ petition within a time frame to be fixed by this Court.
2. The petitioner contends that since there is a title dispute over the property morefully described in the prayer to this writ petition, the official respondents are not empowered to consider the request of the fifth respondent, seeking for issuance of patta in her name. The petitioner has raised several objections in this writ petition, seeking to stall the impugned enquiry to be conducted by the third respondent based on the application submitted by the fifth respondent, seeking for issuance of patta for the property in her name. The very same objections can very well be raised by the petitioner before the third respondent.
3. The petitioner claims that eventhough objections were raised, the same was not considered by the third respondent. Admittedly, no final order has been passed by the third respondent on the fifth respondent's application, seeking for issuance of patta in her name till date. While that be so, the petitioner's interest
will not be prejudiced if a direction is issued to the third respondent to consider the petitioner's objections as raised in this writ petition while deciding the application submitted by the fifth respondent, seeking for issuance of patta in her name for the property morefully described in the prayer to this writ petition. According to the petitioner, since there is a title dispute, patta cannot be issued in favour of the fifth respondent unless and until the title dispute is resolved.
4. Mr. D.Ravichander, learned Special Government Pleader accepts notice on behalf of the respondents 1 to 4. Since no adverse orders are passed against the fifth respondent, notice to the fifth respondent is dispensed with by this Court.
5. This Court is not expressing any opinion on the merits of the petitioner's contentions as well as the merits of the fifth respondent's request for grant of patta in her name.
6. For the foregoing reasons, this Court directs the third respondent to consider the objections raised by the petitioner as raised in this writ petition while deciding the application filed by the fifth respondent, seeking for issuance of the patta in her name for the property morefully described in the prayer to this writ petition within a period of twelve weeks from the date of receipt of a copy of this order.
7. Accordingly, this writ petition is disposed of. No Costs. Consequently, connected miscellaneous petition is closed.
