These applications have been filed to reopen the plaintiff side evidence, to recall P.W.1 and to receive the additional documents on the side of the plaintiffs.

2. The applicants have sought to reopen the plaintiff side evidence and recall P.W.1 for the purpose of marking additional documents viz., the bank statements.

3. In the counter, the stand taken by the respondent is that the factum of tenancy has been brought to light in the course of cross examination and in order to fill up the lacunae, these documents have been sought to be filed.

4. I have perused entire materials. This is a suit for partition and the documents sought are the certified copy of the bank statements. The documents shall be received subject to proof and relevancy and the respondent has every right to cross examine the witness at the time of marking of documents.
