C.M.P.Nos.3291 and 3293 of 2022 in C.M.A.No.(SR).37913 of 2018 P.T. ASHA, J, This petition is filed to condone the delay of 1376 days in re-presenting the above appeal in C.M.A.No.(SR).37913 of 2018. 2.The reasons which have been given in the affidavit filed in support of this petition is that the appellant had lost his source of income as the vehicle, namely, Mahendra Maximo, had been completely damaged and his livelihood had been badly hit and therefore, he could not mobilise the funds to make the mandatory deposit. In the meanwhile, Covid pandemic had been caused and thereafter, he has made necessary arrangements for payment of deficit Court fees as well as the mandatory process. In this process, the delay has been occurred.

mps 3.Considering the fact that the period of delay is 1376 days in re-presenting the appeal, the delay is condoned on condition that the petitioner shall pay a sum of Rs.2,500/- (Rupees two thousand five hundred only) as costs to the Madras High Court Advocate Clerks Association on or before 15.03.2022 and produce a receipt for the same.

4.In the light of the delay being condoned in C.M.P.No.3291 of 2022, C.M.P.No.3293 of 2022 is also condoned. Post on 16.03.2022 for reporting compliance.
