ORDER
The Revision challenges the dismissal of the petitioner's application filed under Section 175 (B) of BNSS seeking registration of the FIR on the complaint given by the petitioner.
2.According to the petitioner, she had borrowed a sum of Rs.2,00,000/- from the proposed accused; that the proposed accused demanded exorbitant interest and failed to return the signed bond and cheques, though the petitioner had repaid the principal amount and hence, the proposed accused is guilty of the offences under Sections 10A, 11 & 17 of the Pondicherry Money Lenders Act, 1970.
3.The learned counsel for the petitioner would submit that apart from the offences under Sections 10A, 11 & 17 of the Pondicherry Money Lenders Act, 1970, the proposed accused has also committed the offences under Section 351 of BNS and hence, the learned Magistrate ought to have directed registration of the FIR.
4.The learned Public Prosecutor per contra submitted that the offences under Sections 10A, 11 & 17 of the Pondicherry Money Lenders Act, 1970 are
non-cognizable and no offence under Section 351 of BNS has been made out, as there is no real threat.
5.It is seen that the offences under Sections 10A, 11 & 17 of the Pondicherry Money Lenders Act are non-cognizable offences. Under Section 12 of the Pondicherry Money Laundering Act, the Court can take cognizance of an offence, only on the complaint in writing given by the prescribed authority. Further, there is no real threat attracting the offence of criminal intimidation. Therefore, there cannot be a direction to register the FIR and the impugned order is justified. This Court finds no infirmity in the impugned order. 6.Accordingly, the Revision is dismissed.
