The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 420 r/w 34 of IPC in Crime No.12 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that petitioner along with other accused have represented as "Shahul Group of Company" and assured the defacto complainant to give the invested amount double. After believing the words of the petitioners, the defacto complainant invested a sum of Rs. 20,00,000/- in the aforesaid company. Later, the petitioners cheated the defacto complainant. Hence the case.

3. The learned Counsel appearing for the petitioner would submit that the petitioner is working as an Accountant of "Shahul Group of Company". He has no knowledge about the defacto complainant's allegation. Hence, he prayed to grant anticipatory bail for the petitioner.

4. The learned Government Advocate (Crl. Side) submitted that A1 who induced the Defacto complainant to invest him in the above said Company. Following which, the Defacto complainant had invested a sum of Rs.20,00,000/- in that company. Thereafter, he paid a sum of Rs.7,00,000/- only and failed to repay the balance amount. Hence, he opposed for grant of anticipatory bail to the petitioner.

5. Heard, learned counsel for the petitioner and also learned Government Advocate (Crl.Side) appearing on behalf of the respondent.

On perusal of the records, it is seen that the petitioner and the other accused persons have induced the defacto complainant to invest in the above said company by giving a false promise that they would double the invested amount. On believing the words of the accused persons, the defacto complainant gave 20,00,000/- to the petitioners. Thereafter, they repaid only 7,00,000/- to the defacto complainant and also failed to repay the balance amount. Therefore, this case needs detailed investigation, this Court is not inclined to grant anticipatory bail to the petitioner.

7.Accordingly, this Criminal Original Petition stands dismissed. 27.02.2023 dk
