PRAYER : Writ Petition filed Under Article 226 of the Constitution of India praying to issue (a)Writ of Declaration, declaring G.O.(Ms).No.09, A.H.D.F & Fishermen Welfare (AH5-2) Department, dated 08.02.2024 as violative of fundamental rights under Article 19(l)(g) read with Article 14 of Constitution of India and hence void and consequently, (b) Writ of Mandamus to categorize the Animal Husbandry Assistant posts as the skilled Government service posts and re-fix the scale of pay of the Members of Petitioner Association with promotional and monetary benefits by implementing VII Pay Commission Report in respect of the post of Animal Husbandry Assistant under the category of other Trade Posts as G.O.(Ms).No.338, Finance (Pay Cell) Department, dated 26.08.2010 and to provide all the arrears accruing.

ORDER

This Writ Petition has been filed in the name of the Association. The learned counsel for the petitioner placed reliance on an earlier order in W.P.No.11798/2022 dated 01.06.2023 wherein the petitioner Association had filed a Writ Petition in the nature of a Mandamus seeking the 2/4

respondents to categorize Animal Husbandry Assistant posts as skilled Government service posts. The same relief has been sought in the present Writ Petition.

2. If any individual person has a grievance then he/she can approach the Court individually by filing a Writ Petition. The Association cannot raise the same issue again.

3. The learned counsel who appears through Video conferencing seeks permission of this Court to withdraw the case.

4. In view of the above, this Writ Petition stands dismissed as withdrawn. However, liberty is granted to any individual to approach the Court in the manner known to law. No costs.
