O R D E R

This Contempt Petition has been filed to punish the contemnors for non-compliance of the order dated 08.03.2024 passed by this Court in W.P.No.25626 of 2022, thereby directed the contemnors to pass appropriate orders declaring that the petitioner had successfully completed his probation period and regularize the service of the petitioner as on 31.08.2014 in the post of Junior Assistant from the date of his initial appointment. Further, the contemnors are directed to give notional promotion to the petitioner to the post of Assistant and Sub Registrar Grade-2, on par with his junior and to grant all consequential benefits to the petitioner within a period of eight weeks from the date of receipt of a copy of the order.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

This Court also observes that the scrutiny of the petitioner's community is pending before the State Level Scrutiny Committee, since the petitioner was selected and appointed as Junior Assistant under the Scheduled Tribe Quota. The Tamil Nadu Public Service Commission had referred the matter to the Committee to ascertain the genuineness of the community certificate. Pursuant to the same, the Committee, by 2/4

proceedings dated 16.06.205, has found that the petitioner does not belong to the Kurumans Scheduled Tribe Community and the community certificate produced by the petitioner is not genuine. Therefore, the community certificate has been cancelled.

4. In the light of the above, the very basis of the petitioner's appointment is now under question. Therefore, no case of contempt is made out as against the respondent.
