Respondent Prayer: Criminal Original petition is filed under Section 482 of Criminal Procedure Code, to direct the respondent to execute the Non-Bailable Warrant dated 24.10.2017 issued against the accused person in S.T.C. No.175 of 2016, pending on the file of Judicial Magistrate No.II, Tindivanam within the stipulated time as may be fixed by this Hon'ble Court and further direct Court below to dispose the said case expeditiously.

ORDER

This petition has been filed to direct the respondent to execute the NBW issued against the accused in STC.No.175 of 2016 on the file of the Judicial Magistrate No.2, Tindivanam, at early.

2. The learned counsel for the petitioner has submitted that based on the complaint filed by the petitioner herein, the case was taken on file in STC.No.175 of 2016 on the file of the Judicial Magistrate No.2, Tindivanam against one N.Selvaraj for the offence punishable under Section 138 of the Negotiable Instruments Act. He further submitted that the said accused though initially appeared before the Trial Court, subsequently did not appear. Hence, NBW was issued on 24.10.2017 and from https://hcservices.ecourts.gov.in/hcservices/

that date onwards, the NBW is pending, hence he requests to direct the respondent to execute the said NBW and secure the accused and produce before the Trial Court at early.

3. The learned Additional Public Prosecutor has submitted that a reasonable time may be granted for executing the NBW.

4. Considering the aforesaid submissions, the respondent is directed to execute the NBW which was issued against the accused N.Selvaraj in STC.No.175 of 2019 on the file of the Judicial Magistrate No.II, Tindivanam and secure the accused and produce before the concerned Trial Court within a period of three months from the date of receipt of a copy of this order.

5. With the aforesaid directions, this petition is disposed of.
