This petition is filed to condone the delay of 326 days in filing the petition to set aside the abatement caused due to the death of the sole appellant.

2. The learned counsel appearing for the second respondent did not raise any serious objection in allowing this petition.

3. This Court is also satisfied with the reasons assigned in Paragraph no.4 of the affidavit filed in support of this petition and in the facts and circumstances, the petition is allowed.

4. The Registry is directed to carryout the necessary amendment in CMA.No.2494 of 2013 and list the main case on 28.02.2020.
