When the matter is taken up for hearing, there is no representation on behalf of the petitioner. This petition is filed to condone the delay of 32 days in filing the application to restore the petitions in C.M.P. Nos.17397 and 17399 of 2018 which was dismissed for default on 13.12.2019 for non prosecution of the applications.

2. It is seen from the records that the sole respondent in the Second Appeal is dead long back and no steps have been taken by the appellant to bring on record the legal heirs of the deceased sole respondent.

3. In view of the same, the Civil Miscellaneous Petition is dismissed as abated.
