O R D E R

The petitioner, who was arrested and remanded to judicial custody on 10.12.2025 for the alleged offence punishable under Sections 326, 303(2) of BNS and 21(1) of Mines and Minerals (Development & Regulation) Act, 1957, in Crime No.768 of 2025 on the file of respondent police seeks bail. 1/4

2. The allegation against the petitioner is that the petitioner joined hands with other accused quarried illegally three bags of river sand from Balaru and the same was transported by using two wheeler without any valid permission from the Government. Hence, the case has been registered and the petitioner has been arrested on 10.12.2025.

3. It is seen that, this is the second anticipatory bail petition filed by the petitioner, earlier petitioner's bail petition was dismissed by stating the following reasons:

"Considering the fact that though the properties have been recovered from the petitioner; that the petitioner is having nine previous cases out of four cases are similar in nature; and if bail is granted to the petitioner he would damage ecology and river bed, hence, this Court is not inclined to grant bail to the petitioner"

4. Now, without any change in circumstances, present petition is filed. Hence, this Court is not inclined to grant bail to the petitioner. 2/4
