ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences under Sections 341, 294 (b), 324, 307 and 506(2) of IPC and under sections 3(1) of the Tamil Nadu Public Property (Prevention of Damage & Loss) Act, 1992, in Crime No.68 of 2022 seeks anticipatory bail.

2. As per the FIR, the petitioner herein had intercepted the defacto complainant's lorry and has picked up a quarrel with the lorry driver for rash driving. When the defacto complainant resisted, the petitioner wielded a sword and tried to attack the defacto complainant and he has also damaged the head light and the rear view mirror of the lorry. Thereafter on intervention of the public, the petitioner has left the scene.

3. The learned counsel for the petitioner would state that it was merely a wordy quarrel for rash and negligent driving of the defacto complainant and further no incident has been alleged in the FIR. https://hcservices.ecourts.gov.in/hcservices/

4. The learned Government Advocate (Crl. Side) appearing for the respondent would show the video clippings of the incident which has been recorded indicates the full averments found in the FIR. In the said footage, the petitioner herein was carrying a sword like weapon, which is about 3 feet length seen wielding it towards the defacto complainant and thereby caused damages to the defacto complainant and to his vehicle.

5. After seeing the visual proof of the overt act of the petitioner, this Court is not inclined to entertain this anticipatory bail petition.
