Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, to call for the records from the respondent herein in Na.Ka.No.2140/2016/K6 dated 24.01.2018 and quash the same and consequently, direct the respondent to sanction the subsidy amount of Rs.50,000/- for the agricultural loan availed by the petitioner and give priority for free electricity service connection for Agriculture.

This matter is taken up for hearing through Video Conferencing mode.

2. This writ petition is filed challenging the order of the respondent dated 24.01.2018 refusing to grant subsidy of Rs.50,000/- and also priority for free electricity service connection for agriculture on the reason that the petitioner has obtained the loan directly from the bank.

3. Heard both sides and perused the materials placed before https://hcservices.ecourts.gov.in/hcservices/

this Court.

4. A careful perusal of the impugned order would show that even though the petitioner's request for grant of subsidy and priority for free agricultural electricity service connection was rejected, the respondent himself has stated that if the petitioner files appropriate application, the same will be considered by the District Committee and action will be taken for grant of subsidy and also priority for agricultural service connection. Therefore, I am of the view that the petitioner can once again go before the respondent and make appropriate application seeking for subsidy and also priority for free agricultural service connection.

5. The learned Special Government Pleader fairly submitted that the matter may be remitted back to the respondent for enabling the petitioner to make such application and the respondent to consider the same as stated in the impugned order itself.

6. Accordingly, this Writ Petition is disposed of, only by directing the petitioner to make appropriate application before the respondent within a period of two weeks from the date of receipt of a copy of this order. On receipt of such application, the same shall be considered and appropriate orders shall be passed for grant of subsidy as well as priority for free agricultural electricity service connection.
