ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police in connection with a case registered in Crime No.146 of 2020 for the alleged offence under order 6(4) of Tamil Nadu Scheduled Commodities (RDCS) Order 1982 and 7(1)(a)(ii) of The Essential Commodities Act, 1955 seeks anticipatory bail.

2. The petitioners said to have transported 6600 KGs of rice meant for public distribution system. The petitioners were said to have been arrayed as A1 and A2 respectively.

3. The learned counsel for the petitioner would submit that the petitioners innocent of the alleged offence. They have been falsely implicated.

4. The learned Additional Public Prosecutor would submit that the petitioners transported 6600 KGs of rice meant for Public Distribution System illegally and the 1st petitioner has one previous case of similar nature registered against him while the 2nd petitioner has two previous cases of similar nature registered against him.

Considering the nature of the offence and also the alleged involvement of the 1st petitioner in another cases of similar nature and the involvement of the 2nd petitioner in two other cases of similar nature, this court is of the considered view that it is not a fit case for the grant of anticipatory bail as there is every possibility of repeating the offence by the petitioner, if he is released on bail.
