.. Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India

praying to issue a Writ of Mandamus, directing the 1st and 2nd respondent to pass appropriate orders to allow the petitioner to continue as 'Clerk' in the 3rd respondent society and consequently pay the arrears of salary from May 2024.

ORDER

This Writ Petition has been filed in the nature of a Mandamus seeking a direction against the 1st and 2nd respondents to pass orders to permit the petitioner to continue discharge duty as Clerk in the 3rd respondent society. The petitioner also seeks arrears of salary from May 2024 should also be paid to him.

2.Let me not enter into the discussion on the facts necessitating the

respondents not to permit the petitioner to work, but it is informed today that the petitioner has joined duty yesterday / 26.02.2025. The respondents may take a decision as to how they would categorize the period during which the petitioner had not reported to duty. At any rate, the petitioner cannot be prevented from discharging duty unless specific orders in writing are passed. The employer and employee relationship still continues between the petitioner and the respondents. No further directions are required. 3.With the above observations, this Writ Petition stands disposed of. No costs.
