Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue Writ of Mandamus to direct the respondents 1 and 2 to give police protection to the petitioner and his family with regard to his patta land to an extent of 0.65 Acres comprised in Survey Number 78/3B and an extent of 0.47 acres in S.No.78/2B3 situated at Katheri-2 Village, Krishnagiri Taluk and District. This writ petition has been filed for the issue of writ of Mandamus directing the respondent police to provide police protection to the petitioner and his family and also his property.

It is seen from records that there is a dispute with regard to the usage of a water channel and according to the petitioner, the private respondents have encroached upon the water channel and put up a construction. It is therefore clear that there is a private dispute between the parties. The petitioner has to work out his remedy only before the appropriate civil court and the police cannot interfere in a case of this nature. Except giving this liberty, no further orders can be passed in this writ petition and accordingly, this writ petition is disposed of. No costs. 04.03.2021 Index : Yes/No Internet : Yes/No rka To
