The applicant states that the additional documents were served on the respondent / plaintiff while contesting the interlocutory application. It is stated that the said documents were not filed along with the written statement on account of inadvertence. The respondent / plaintiff has no objection to this application being allowed subject to objections, inter alia, on grounds of relevance and proof.
2. The suit is at the pre trial stage. Most of the additional documents appear to have been served on the respondent / plaintiff in course of hearing of interlocutory applications. In the facts and circumstances, the applicant / defendant has established reasonable cause. Accordingly, A.No.819 of 2022 is allowed by permitting the applicant / defendant to file the additional documents set out in the schedule to the Judge's summons.
