PRAYER in WPs: Writ Petitions filed under Article 226 of the Constitution of India praying for a writ of Mandamus to direct the 1st respondent to dispose by commercial tax appeal pending in CTA No.26 of 2013 within time frame as may be fixed by this Court.

O R D E R

The short prayer in this Writ Petition is for a direction to the Sale Tax Appellate Tribunal (Addl. Bench), Coimbatore/the first respondent in this Writ Petition to dispose of Commercial Tax Appeal No.26 of 2013 within a fixed time frame.

2. Mr.Haribabu, learned Additional Government Pleader takes notice for the respondents and reports today that only nine (9) matters are pending before the Sales Tax Appellate Tribunal.

3. It is seen that other appeals of this petitioner are also pending before the Sales Tax Appellate Tribunal (STAT) in regard to the disposal of which the petitioner had approached this Court in WP. Nos.463 to 469 and 472 of 2019 seeking an identical prayer as in the present petition. By order dated 08.01.2019, a learned single Judge of this Court had directed https://hcservices.ecourts.gov.in/hcservices/

the Sales Tax Appellate Tribunal (STAT), (Addl. Bench), Coimbatore to dispose the appeals within a period of six (6) weeks from the date of receipt of a copy of that order. Despite the same, the appeals are yet pending.

4. In the light of the above, the Sales Tax Appellate Tribunal (STAT), (Addl. Bench), Coimbatore/1st respondent is directed to dispose the appeal in issue in the present Writ Petition along with the other appeals filed by the petitioner, within a period of eight (8) weeks from today.

5. This Writ Petition stands disposed of in the above terms. No costs.
