..Respondents Prayer : To Condone the delay of 784 days in filing the above WA against the Order dated 04.09.2023 made in Wp No. 18363 of 2023. For Appellants :

Order (Order of the Court was made by R.Suresh Kumar J.) This Civil Miscellaneous Petition is filed to condone the delay of 784 days in filing the writ appeal.

2. Heard Mr.R.Neethiperumal, learned Government Advocate appearing for the petitioner / State.

3. Despite notice having been served the the names and addresses of the respondents having been printed in the cause list, none has entered appearance.

4. Though some reasons have been stated in the affidavit filed in support of the petition, since the delay has already crossed 500 days such a huge delay cannot be condoned as a matter of course. Therefore, we are inclined to condone the delay on terms.

5. However, since the respondents have not entered appearance, this Court is inclined to allow the petition on payment of costs by the petitioners. A sum of Rs.5000/- (Rupees Five Thousand Only) shall be paid by the petitioner / State to the Tamil Nadu State Legal Services Authority towards its Environmental Fund , within a period of two weeks from the date of receipt of a copy of this order. On such payment, this petition is ordered.

6. Registry, on verification of the payment by the petitioner, shall number the appeal if it is otherwise in order and post for admission. The CMP is allowed on the above terms.
