HIGH COURT LEGAL SERVICES COMMITTEE, CHENNAI Lok Adalat-I organised by the High Court Legal Services Committee Monday, the 30th day of March 2015 LOK ADALAT AWARD (Chapter VI and u/s 21 of Legal Services Authorities Act, 1987) Presided over by The Hon'ble Mr.JUSTICE MALAISUBRAMANIAN (Retd.) and Members 1.Mr.R.Paranjothi, District Judge (Retd) 2.Ms.Ayesha Fathima W.P.No.13647 of 2011 and M.P.No.1 of 2011 (This Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of writ of certiorarified Mandamus to call for the entire records connected with the impugned order passed by the third respondent in Ku.No.436 / Se.Po/ O & M / Seth / Ni.Me/Vul/Ko.uthiya Porutham dated 28.02.2011 and quash the same and direct the respondents to refund a sum of Rs.1,39,929/- and Rs.22,570 with 12% of interest, deducted from the retirement benefits of the petitioner and consequently refix the old scale of pay and pension.

.. Respondents This case came up for settlement before the Lok Adalat. Both parties are present. Mr.S.Gopinath for S.N.Ravichandran, the learned

counsel for the petitioner and Ms.S.Rathi for Ms.R.Varalakshmi, the learned for the respondents 1 to 3 are present. TERMS OF SETTLEMENT The petitioner, who retired as Revenue Supervisor in Tamil Nadu Electricity Board has filed this petition to quash the order of the third respondent, dated 28.02.2011 recovering a sum of Rs.1,39,929/- from the retirement benefits of the petitioner.

2. Both parties are present.

3. The third respondent now have issued a cheque bearing No.599092, dated 27.03.2015 for an amount of Rs.1,54,676/-, drawn on Inidan Overseas Bank, Chetpet Branch, Thiruvannamalai District towards the amount already recovered from the petitioner. The petitioner also has received the same.

4. Since the prayer of the petitioner has been complied with, the writ petition stands disposed off as settled. Consequently connected Miscellaneous Petition is closed.

The full Court fee paid shall be refunded to the petitioner in the manner provided under Section 69-A of the Tamil Nadu Court-Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.
