ORDER

The petitioners, who apprehends arrest for the alleged offence under Sections 316(2), 318(4) and 351(3) of BNSS 2023 (406, 420 and 506(2) IPC) in Cr.No.17 of 2025 on the file of the respondent police seek anticipatory bail.

2.The allegation against the petitioners is that they joined hands with other accused, borrowed a sum of Rs.34 lakhs from the defacto complainant, and thereafter issued a cheque which was dishonoured, thereby cheated the defacto complainant. Hence, the case.

3.The learned counsel for the petitioners submitted that a cheque dishonour case in STC/0001341/2024 is already pending. He further submitted that co-accused in this case is released on anticipatory bail in Crl.O.P.No.31081 of 2025 on 14.11.2025 and the petitioners are ready to abide by any stringent conditions that may be imposed by this Court. Hence prays to grant anticipatory bail to the petitioners.

4.The learned Government Advocate (Crl.Side) for the respondent reported that the FIR was recently registered, investigation is pending and the petitioners habitually defaults loans from various persons. He further submitted that there are three previous cases pending against the petitioners which are similar in nature. Hence he opposed for grant of anticipatory bail to the petitioners.

5. Considering the submissions made by both sides and the facts of the case; that there are three previous cases pending against the petitioners; though

it is projected by the petitioners that it is a case of default in payment loan amount, closer scrutiny states that they habitually target vulnerable persons and gain sympathy and after collecting money they will abscond and: investigation is pending and the petitioners are habitual offender, I am not inclined to grant anticipatory bail to the petitioners.

6. Accordingly, this Criminal Original Petition is dismissed. 06.02.2026 smn
