PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents 1 to 4 to consider petitioner's appeal representation dated 27.01.2023, consequently direct the 2nd 1/4

respondent to confirm the patta Document No.222 stands in petitioner's name in respect of Natham Plot situated at Kanchipuram District, Sholinganallur Taluk Village No.10, Palavakkam, New Survey No.157/2, Old Survey No.16/3B which is total extent of 0025.

By consent of both the parties, the main writ petition has been taken up for final disposal.

2. The petitioner seeks for a direction to the second respondent to confirm that the patta No.222 stands in his name in connection with New Survey No.157/2, Old Survey No.16/3B, Village No.10, Palavakkam, Sholinganallur Taluk, Kanchipuram District.

Learned Additional Government Pleader produced a copy of the order passed by this Court in W.P.No.2057 of 2023 dated 27.01.2023, filed by the petitioner herein, seeking compensation for the same property, in which, this Court had directed the authorities to refer the dispute to the District Court, as per Section 21(2) of the State Highways Act.

4. The earlier order passed by this Court in WP No.2057 of 2023 has been suppressed in the affidavit filed by the petitioner herein. When this Court had taken cognizance of the dispute between the petitioner and the private respondents therein and referred the matter to District Court, the present writ petition, without reference to the earlier order, cannot be entertained and the prayer seeking for confirmation of patta in petitioner's name does not require consideration. It is always open to the petitioner to work out his remedy in accordance with the direction issued by this Court in WP No.2057 of 2023 dated 27.01.2023.
