Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of mandamus or any other writ or direction in the nature of writ of mandamus directing the respondents to award BDS (Bachelor of Dental Surgery) Degree and consequently release BDS Degree Certificate and Mark sheets within a time frame to be fixed by this Court. O R D E R

Today when the matter is taken up for hearing, there is no representation on behalf of the petitioner. The Grievance of the petitioner is that he has undergone BDS Course in the first respondent institute. Despite he has cleared the exams, the institute is not awarding degree. Whereas the counter filed by the second respondent, it is submitted that as far as the academic class are concerned, the petitioner has attended the class and taken up the examination. Whereas as per the curriculum, he has to undergo the internship https://hcservices.ecourts.gov.in/hcservices/

for one year, in which the petitioner herein has failed to complete. He has attended only five days of internship and due to incompletion of internship, they are not able to award degree to him.

It is specifically stated that in the counter affidavit that the petitioner is entitled for granting BDS degree only after successful completion of Internship as per the norms of the Dental counsel of India. Since the petitioner has not completed his course by undergoing the internship of one year, he is not entitled for degree. Hence, the writ petition is dismissed. No costs. Consequently, the connected Miscellaneous Petition is closed.
