ORDER
This Writ Petition has been filed seeking for direction to 1st and 2nd respondents to take appropriate and immediate action against the 3rd respondent company for violations of the Employees' Provident Funds and Miscellaneous Provisions Act,1952 and consequently, to direct the 3rd respondent to pay the petitioner's pending salary and remit the petitioner's Provident Fund (PF) dues amounting to Rs.70,200/- (Rupees Seventy Thousand Two Hundred only) along with statutory interest and damages, by considering and disposing of the petitioner's representation dated 23.01.2026. 2.
The case of the petitioner is that he joined the 3rd respondent company as a Field Engineer on 28.10.2022 with a monthly salary of Rs.27,008/-. Though PF contributions were regularly deducted from his salary, the 3rd respondent failed to remit the same to the concerned authorities. Despite rendering satisfactory service, the petitioner as neither granted salary increments nor paid his salary for four months. Repeated requests and representations made
by the petitioner regarding the non-payment of salary and PF dues did not evoke any response. Consequently, the petitioner resigned from service on 09.01.2025 and sought settlement of his pending salary, PF dues and issuance of service certificates. Although a Relieving-cum-Experiencing certificate was issued on 18.05.2025, the 3rd respondent failed to pay the arrears of salary amounting to Rs.1,08,000/- and PF dues of Rs.70,200/-. The petitioner thereafter issued a legal notice dated 01.12.2025 and submitted further representation dated 23.01.2026, but no action was taken by the respondents. Aggrieved by the failure of the respondents to settle his lawful dues, the petitioner has approached this Court seeking appropriate relief.
3. Heard the learned counsel appearing for the petitioner and the learned Government Counsel appearing for the respondents 1 and 2.

Considering the facts and circumstances of the case and the submissions made by the learned counsel appearing for both sides, this Court, without going into the merits of the case, directs the 3rd respondent to consider the representation of the petitioner dated 23.01.2026 and pass appropriate orders, on merits and in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order.
5. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
