Respondents in both the Writ Petitions Writ Petitions filed under Article 226 of the Constitution of India, praying for issuance of Writs of Mandamus to direct the first respondent herein to permit the petitioners to write the forthcoming examinations for Diploma in Nautical Science Leading to B.Sc. Nautical Science to be held on 12.06.2018, 13.06.2018 and 14.06.2018 by following necessary procedures. For petitioners : Mr.A.Tamilvanan for Mr.S.Prem Auxilian Raj in W.P.No.10597 of 2018 Mr.C.Balaji in W.P.No.11230 of 2018 For respondents : Mr.K.R.Thamizhmani for R-1 in both W.Ps Mr.Godson Swaminathan for M/s.Issac Chambers RR-5 and 6 in both W.Ps.

ORDER

The petitioners have come forward with the above Writ Petitions praying for issuance of Writs of Mandamus to direct the first respondent herein to permit the petitioners to write the forthcoming examinations for Diploma in Nautical Science Leading to B.Sc. Nautical Science to be held on 12.06.2018, 13.06.2018 and 14.06.2018 by following necessary procedures.

2. When the Writ Petitions are taken up for hearing, it is submitted by either side that the petitioners have written the abovesaid examinations. Learned counsel for the respondents 5 and 6 submitted that the respondents 5 and 6 are willing to pay a sum of Rs.5 lakhs (Rupees five lakhs only) in respect of each of the petitioners herein, to the first respondent-University, within one week from the date of receipt of a copy of this order, as the petitioners/students have been admitted to the second respondent-institution as early as in 2010/2011. It is further stated that the respondents 5 and 6 are not running the affairs of the institution and the same had been handed over to the other persons. It is further submitted that eversince the candidates have been admitted during their term of office, they are willing to take moral responsibility of paying the said amount in respect of each of the petitioners, to the first respondent-University.

Learned counsel for the first respondent-University submitted that on payment of Rs.5 lakhs each in respect of each of the petitioners by the respondents 5 and 6 to the first respondent-University, which is due to the first respondentUniversity, the results will be released by the first respondent-University within 48 hours from the date of receipt of the amount.

4. While recording the above submissions made by the respondents 1, 5 and 6, both the Writ Petitions are disposed of. No costs.
