O R D E R
The prayer sought for herein is for a Writ of Mandamus directing the 1st to consider the petitioner's representation dated 23.11.2022 and issue patta with rectified measurement for the land in Survey No.28/5 Part 33 situated at Plot 1 / 4
No.10, Kamaraj Nagar Part III, Puthagaram Village, Kolathur, Chennai 600 099 measuring to an extent of 2115 Sq.ft, the petitioner had filed an appeal for rectifying the patta before the 1st respondent Revenue Divisional Officer (RDO). On receipt of the same, the RDO has also directed the Tahsildar / 2nd respondent to conduct the enquiry and send a report. Despite the same since no progress has been made, the petitioner made a representation on 28.11.2022. Even that also has not been considered and therefore the petitioner has approached this Court after sending a reminder on 18.01.2023 to the 2nd respondent. 2.Heard Mr.V.Stalin, learned counsel for the petitioner and Mr.R.P.Muruganraja learned Government Advocate for the respondents.
3. Learned Government Advocate submits that originally the concerned RDO was the RDO, Tondiarpet, but subsequently the said office has been bifurcated and the present RDO is RDO, Madhavaram, in whose jurisdiction the petitioner's case would come. Therefore, the said representation / appeal given before the 1st respondent would be forwarded by the 1st respondent to the concerned RDO ie., RDO, Madhavaram, who in turn would consider the same and pass necessary orders within a time frame that may be stipulated by this Court. 2 / 4
5. Considering the said submission made by the learned Government Advocate, there shall be a direction to the 1st respondent to forward the appeal filed by the petitioner dated 23.11.2022 and the relevant files to the concerned RDO ie., RDO, Madhavaram within four weeks from the date of receipt of a copy of this order. Thereafter, the said RDO, Madhavaram shall look into the matter and pass necessary orders thereon on merits and in accordance with law within a period of six weeks thereafter. Since the RDO, Madhavaram is not a party to this writ petition, registry is directed to mark a copy of this order to the said authority for necessary action as indicated above.
6. With the above direction, this writ petition is disposed of. No costs. 15.02.2023 Index : Yes/No Speaking Order / Non-speaking order KST To 1 The Revenue Divisional Officer, North Madras Revenue Division Thiruvottiyur Main Road Tondiarpet, Chennai 600 081. 2 The Tahsildar, Madhavaram Taluk Office, Chennai 600 066.
