Mr.V.Meganathan Government Advocate (Crl.Side) ADVANCE ORDER This Criminal Appeal is allowed and the judgment dated 31.01.2025 passed in S.C.No 209/2012 on the file of the learned Additional District Judge (Fast Track Court ) Vellore district , is set aside. The appellant is acquitted of all charges under sections 341, 294(b), 326 and 307 IPC @ 216 Cr.P.C to 341 r/w. 34, 294(b), 326 r/w. 34 and 307 r/w.34 of IPC.
2. The period undergone is ordered to be set off and the fine amount of fifty thousand rupees has already been paid. It is ordered to hand over compensation to PW1 for the injuries sustained by him. Admittedly, A2 died during pending proceedings, and the charge against A2 abates. However, the entire case reveals that the victim/PW1's left thumb and index finger got severed. So far, no victim compensation has been awarded by any court.
3. Considering the gravity of the injuries sustained by PW1, this court is inclined to award an interim victim compensation of Rs.3 lakhs. The Victim/PW1 is required to make application for award of compensation as expeditiously as possible. By referring the matter to the District Legal Services
Authority, Vellore. The District Legal Services Authority, Vellore is directed to refer the matter to the District Collector and secure the compensation of three lakhs rupees within a period of twelve weeks from the date of receipt of copy of this order. The Victim/PW1 is permitted to get compensation.
4. It is reported by the learned counsel on either side that the appellant is now in incarceration. The appellant/accused is directed to be set at liberty forthwith unless his custody is otherwise required in connection with any other case. Fine amount, if any paid, shall be refunded to the appellant forthwith. Bail bond, if any executed, shall stand cancelled.
