Prayer: Writ Petition is filed under Section 226 of the Constitution of India for issue of Writ of Certiorarified Mandamus, calling for records on the file of the 2nd respondent in Na.Ka.No.65903/2005/Pa2 dated 2l.03.2007, Proceedings in Na.Ka.No.65903/2005/Pa2 dated 24.03.20l0 and the Proceedings No.5437/2017/DPC1.2 dated 20.10.2022 issued by the 1st respondent herein, quash the same and to issue directions to the 1/5

respondents herein to declare that the petitioner has been retired peacefully on attaining the age of superannuation on 30.06.2016 and to grant him all consequential retirement and pensionary benefits with interest on the delayed payments.

O R D E R

This writ petition is filed for the following relief: "To call for records on the file of the 2nd respondent in Na.Ka.No.65903/2005/Pa2 dated 2l.03.2007, Proceedings in Na.Ka.No.65903/2005/Pa2 dated 24.03.20l0 and the Proceedings No.5437/2017/DPC1.2 dated 20.10.2022 issued by the 1st respondent herein, quash the same and to issue directions to the respondents herein to declare that the petitioner has been retired peacefully on attaining the age of superannuation on 30.06.2016 and to grant him all consequential retirement and pensionary benefits with interest on the delayed payments".

2. The impugned orders have been issued without notice to the petitioner without traversing through the facts of the case and the documents the impugned orders are quashed and the matter is remitted back to the 2nd respondent for fresh consideration after due notice to the petitioner and giving him an opportunity of personal hearing. The impugned orders shall be treated as a show cause notice and an explanation shall be submitted by the petitioner. Thereafter, within a period of 2 months, the 2nd respondent shall pass orders on merits and in accordance with law.

3. With the above direction, this writ petition is allowed. Consequently, the connected miscellaneous petitions are closed. No costs.
