On 02.08.2016, the learned counsel appearing for the revision petitioner reported no instructions for the revision petitioner and therefore, notice was issued to the revision petitioner through the Registry. Today, there is no appearance on behalf of the revision petitioner and respondent.
2. The present Civil Revision Petition is filed against the fair and
decreetal orders passed in EA.No.368 of 2012 in EP.No.257 of 2008 in OS.No.157 of 2006 on the file of the Principal Subordinate Court, Vriddhachalam.
3. A perusal of the records shows that EA.No.368 of 2012 is filed by the revision petitioner to stay the Execution Petition till the revision petitioner gets an order in the appeal filed by him. The learned Principal Subordinate Judge, Vriddhachalam has observed that the application is filed by the revision petitioner only to stall the proceedings in the Execution Petition in EP.No.257 of 2008. Even in the memorandum of grounds filed in the present Civil Revision Petition, nothing is mentioned about the details of the appeal filed by the revision petitioner. In the facts and circumstances, the present Civil Revision Petition is dismissed. No costs. Consequently, the connected Miscellaneous Petition is closed.
