ORDER

This petition has been filed to withdraw and transfer the case in HMOP.No.521 of 2022 pending on the file of the Family Court, Salem, to the file of the Family Court, Namakkal for joint Trial of the maintenance case in M.C. No.19 of 2023.

Heard the learned counsel on both sides.

The learned counsel appearing for the petitioner would submit that the respondent/husband filed HMOP No.521 of 2022 before the Family Court, Salem seeking for divorce and the same is pending before it. Further, it is submitted that the petitioner has filed a petition for maintenance in M.C. No.19 of 2023 before the Family Court, Namakkal. If HMOP would be transferred to the Family Court, Namakkal, it may be tried jointly along with MC NO.19 of 2023 filed by the petitioner herein. Hence, he seeks the relief as prayed for.

The learned counsel appearing for the respondent/husband would submit that the respondent/husband has no objection in allowing this petition.

I have gone through the affidavit filed in support this petition

and I find merit in the submissions made by the learned counsel for the petitioner/wife.

In view of the above and also considering the consent given by the other side, there can be no impediment for allowing this petition as prayed for.

7.Accordingly, this transfer civil miscellaneous petition is allowed. The case in HMOP No.521 of 2022 is hereby withdrawn from the file of the Family Court, Salem, and transferred to the file of the Family Court, Namakkal. The learned Judge shall expedite the disposal of the case in HMOP No.521 of 2022. No costs. Connected C.M.P. is closed. 12-09-2025 lbm Index:Yes/No Speaking/Non-speaking order Internet:Yes;
