ORDER

The petitioner, who was arrested and remanded to judicial custody on 03.05.2025 for the offences punishable under Sections 302, 341, 120(B) & 34 of IPC, in Crime No.860 of 2018, registered on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner was earlier arrested and released on bail. Subsequently, due to health issue, the petitioner did not appear before the concerned trial Court, and hence Non-Bailable Warrant (NBW) was issued against him on 01.04.2025 and the same was executed on 03.05.2025.

3. The learned counsel appearing for the petitioner submitted that the NBW was issued in March 2025 and was immediately executed, and that the petitioner has been co-operating with the trial proceedings. He further submitted that due to health issues, the petitioner was unable to appear before the trial Court and he is in judicial custody since 03.05.2025. He further submitted that he is ready to co-operate with the trial. Hence, he prays to grant bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and submitted that the petitioner was frequently absconding, due to which the Trial Court issued NBW, and he was subsequently arrested. He further submitted that the case is now pending for framing of charges and that the petitioner has 13 previous cases pending against him including three murder cases. Hence, he opposed to grant bail to the petitioner.

5. This Court on perusal of the order of the Trial Court, finds that the petitioner was granted bail on two occasions and had jumped bail. Thereafter, 2/4

once again he was arrested and the Trial Court has recorded that the petitioner adopted delay tactics. Considering the conduct of the petitioner and his involvement in several previous cases, this Court is not inclined to grant bail to the petitioner.
