[Order of the Court was made by M.S.RAMESH, J.] The petitioner seeks modification of order in paragraph 5(iv) in W.P.No.26199 of 2023 dated 31.10.2023, while granting leave to the convict prisoner, Sakthi @ Sakthivel, S/o. Palanisamy, aged about 42 years, bearing Convict No.23598, for a period of 20 days from 10.11.2023 to 30.11.2023.

2. This Court, through orders dated 31.10.2023, in W.P. No.26199 of 2023, directed as follows:

"5....

(iv) It is clarified that the cost involved in providing escort shall be borne by the petitioner. "

3. The petitioner submitted that after the completion of the leave period, as per the orders of this Court in W.P. No.26199 of 2023 dated 31.10.2023, the life convict surrendered on 30.11.2023 and thereafter, the 3rd

respondent has claimed a sum of Rs.1,60,642/- as police escort duty charges from 10.11.2023 to 30.11.2023. Since the petitioner's family is not in a position to pay a huge amount of escort fee, she seeks modification of the abovesaid condition.

4. Learned Additional Public Prosecutor did not raise any serious objection in modifying the abovesaid condition.

5. In view of the said submission made on either side, we deem it appropriate to modify the condition imposed by this Court in paragraph 5(iv) in W.P. No.26199 of 2023 as follows:

"It is clarified that the cost involved in providing escort shall be borne by the petitioner, subject to a maximum of Rs.20,000/-."

6. With the above modification, this Writ Miscellaneous Petition stands

ordered.
