The learned Advocate Commissioner appointed by this Court would submit that as per the directions of this Court, he has repossessed the machineries and handed over custody of the same to the plaintiff. Therefore, Application No.200 of 2023 seeking appointment of an Advocate Commissioner as well as Application No.117 of 2023 seeking to direct the respondent/defendant to release the machineries, are closed, and the parties are granted liberty to agitate their grievance in the main suit.

2. The applicant/plaintiff and the respondent/defendant are directed to pay jointly a total sum of Rs.30,000/- to the Advocate Commissioner towards his additional remuneration within a period of one week from the date of receipt of a copy of this order. 1/3

3. Post the matter for counter and disposal in Application No.115 of 2023, as well as for filing of an affidavit of admission/denial of documents, on 22.01.2023.
