Respondent Criminal Original Petition has been filed under Section 439(1)(b) of Cr.P.C., praying to modify the conditions of depositing a sum of Rs.5,00,000/- and to appear before the respondent police for a period of 30 days, being imposed by the learned Principal Sessions Judge, Vellore, Vellore District in Crl.M.P.No.4551 of 2021 by order dated 23.12.2021. O R D E R

This Criminal Original Petition has been filed praying to modify the conditions of depositing a sum of Rs.5,00,000/- and to appear before the respondent police for a period of 30 days, being imposed by the learned Principal Sessions Judge, Vellore, Vellore District in Crl.M.P.No.4551 of 2021 by order dated 23.12.2021.

2.The petitioner, after getting anticipatory bail from the Principal Sessions Judge, Vellore, Vellore District in Crl.M.P.No.4551 of 2021, dated 23.12.2021, had approached the High Court under Section 482 of Cr.P.C in Crl.O.P.No.22558 of 2021 and sought for quash of the First Information Report. In the said petition, this Court has passed an order of interim stay for all further proceedings. In such circumstances, this https://hcservices.ecourts.gov.in/hcservices/

petition has been filed for modification of bail condition imposed by the the Principal Sessions Court.

3.Whether such modification can be done, when there is an order of stay for all further proceedings has to be considered by the learned Judge, who has passed the order of stay.
