The petitioner, who apprehends arrest by the respondent police is before this court claiming that he is an innocent person and he is no way connected to the said seizure of 15 bottles of brandy alleged to have smelled poisonous.

However, the learned Government Advocate (Crl.side) states that when the police was surveilling the area around Divya Theatre, they found the petitioner waiting in a two wheeler bearing Regn.No.TN 90 F 9772 with a bag in a suspicious manner. When he was intercepted by the police, he left the vehicle and ran away. On inspecting the bag, the respondent police found 15 brandy bottles containing 180 ml each.
When they tested the content of the brandy, smell emanated and therefore, they suspected them to find out any substance is added which may cause injury to health for more intoxication and the contraband was seized and sent for laboratory and they are awaiting for the lab report.
3.In view of the above, this Court finds that it is not a fit case to grant anticipatory bail to the petitioner herein, since the vehicle found and seized from the spot is owned by the petitioner herein and it is still at lab.
4. Hence the anticipatory bail is dismissed.
